Terms of Service

These Terms of Service ("Terms") govern your access to and use of Atune Audio (the "App") and related websites and services operated by Ironwood Software LLC ("Ironwood," "we," "us," or "our").

Please read these Terms carefully. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms are provided for operational clarity and do not constitute legal advice. They have not been reviewed by counsel unless and until Ironwood publishes a revised version stating otherwise.

1. Acceptance of Terms

You represent that you are at least 13 years of age (or the minimum age required in your jurisdiction to use the App with parental consent, if higher) and have the legal capacity to enter into these Terms. If you use the App on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of the Service

Atune Audio is a self-hosted media client. The App allows you to connect to media servers you configure — such as Jellyfin, Emby, Navidrome, OpenSubsonic-compatible servers, and Audiobookshelf — to browse, play, download, and manage personal media stored on those servers.

Ironwood does not host user media, operate a streaming catalog, or provide media libraries. Connections are made between your device and servers you choose. Ironwood Software LLC does not review, monitor, or control the content stored on user-operated servers.

3. License to Use the App

Subject to these Terms, Ironwood grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use (unless otherwise permitted by applicable app store terms or a separate written agreement with Ironwood).

You may not:

  • Copy, modify, distribute, sell, lease, or sublicense the App except as expressly permitted
  • Reverse engineer, decompile, or attempt to extract source code except where applicable law expressly allows
  • Remove or alter proprietary notices
  • Use the App to build a competing product using unauthorized access to our services or code
  • Circumvent technical measures, entitlement checks, or security controls

4. Ownership

The App, website, trademarks, logos, and related intellectual property are owned by Ironwood Software LLC or its licensors. These Terms do not transfer any ownership rights to you. Content accessed through servers you connect remains the property of its respective owners.

5. User Responsibilities

You are solely responsible for:

  • Servers, credentials, networks, and devices you use with the App
  • Content you access, download, store, or play through the App
  • Compliance with applicable laws, server terms, and third-party rights
  • Maintaining backups and security of your libraries and devices
  • Ensuring that anyone using the App on your device or servers does so with appropriate authorization

6. Acceptable Use

You agree not to use the App to:

  • Violate any applicable law or regulation
  • Infringe intellectual property, privacy, or other rights of others
  • Access servers or content without authorization
  • Interfere with or disrupt the App, our systems, or third-party services
  • Transmit malware or engage in fraudulent, abusive, or harmful activity
  • Misrepresent your identity or affiliation

7. Copyright Compliance and Authorized Content

Atune Audio is a self-hosted media client. It is a tool that allows you to access media from servers you connect and control.

Ironwood Software LLC does not host, distribute, transmit, or provide copyrighted content. Atune Audio does not provide media libraries and does not provide access to movies, music, books, podcasts, or other copyrighted works. The App does not include a catalog of licensed or unlicensed media supplied by Ironwood.

Any content you access through the App comes from servers and sources you configure. You are solely responsible for the content accessed through servers connected to Atune Audio, for ensuring you have the legal right to access and use that content, and for complying with applicable copyright and intellectual property laws.

You agree that you will not use Atune Audio to:

  • Infringe copyrights or other intellectual property rights
  • Access, reproduce, distribute, or display content without proper authorization
  • Facilitate unauthorized sharing or distribution of copyrighted works
  • Engage in or promote piracy or other unlawful copying or distribution

Ironwood Software LLC does not endorse, encourage, assist, or support copyright infringement or other unlawful use of content. Ironwood does not monitor user media libraries and does not determine whether content on your servers is lawfully obtained.

If we receive credible information that the App is being used unlawfully, or if we are required to do so by law, Ironwood reserves the right to suspend or terminate access to the App or related services to the extent permitted by applicable law and platform policies.

If you believe content accessible through a third-party server infringes your rights, you should address that matter with the operator of the relevant server or through appropriate legal channels. Ironwood is not the host of your media libraries.

8. Third-Party Services

The App interoperates with third-party services and software, including media servers, Google Play, RevenueCat, Sentry (if you opt in to crash reporting), Last.fm (if connected), podcast indexes, and casting platforms. Those services are governed by their own terms and policies. Ironwood is not responsible for third-party services, their availability, or their handling of your data.

9. Purchases and Atune Audio Pro

Certain features require Atune Audio Pro, which is purchased through Google Play (or other authorized storefronts when available). Pricing, billing, refunds, and payment disputes are handled according to the applicable app store's policies. RevenueCat may be used to validate entitlements.

Pro features, pricing, and availability may change. Ironwood may modify or discontinue features with reasonable notice where practicable. Purchases are subject to the app store's terms in addition to these Terms.

10. Availability and Changes

We strive to keep the App available and functioning, but we do not guarantee uninterrupted or error-free operation. The App may be modified, updated, or discontinued in whole or in part. Features may depend on third-party servers, devices, networks, and platform APIs outside our control.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

Ironwood disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Ironwood does not warrant that the App will meet your requirements, that operation will be uninterrupted or secure, or that errors will be corrected.

You use the App at your own risk. Ironwood is not responsible for data loss, server misconfiguration, playback issues caused by third-party software, or content accessed from servers you connect.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IRONWOOD SOFTWARE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IRONWOOD'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO IRONWOOD FOR THE APP OR ATUNE PRO IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US $50).

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Ironwood Software LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) content you access, store, or distribute through servers you connect; (c) your violation of these Terms; or (d) your violation of any law or third-party rights.

14. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App or related services if you violate these Terms, if required by law or platform policy, or if we discontinue the App. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, and governing law.

15. Governing Law

These Terms are governed by the laws of [Governing Law — State/Jurisdiction to be specified], without regard to conflict-of-law principles, except where mandatory consumer protection laws of your jurisdiction apply and cannot be waived.

Any dispute arising out of or relating to these Terms or the App shall be brought in the courts located in [Venue — to be specified], unless applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes may be communicated through the App, website, or other reasonable notice. Your continued use of the App after updated Terms become effective constitutes acceptance, except where applicable law requires otherwise.
